1. Agreement

By using the TryPenguin service, you agree to these terms with Mint Nimbus Pty Ltd as trustee for G&G Anderson Family Trust (ABN 21 527 913 094) trading as TryPenguin (“we,” “our,” “us”). If you do not agree with these terms, do not use the service.

“The service” means the TryPenguin AI-powered CV and interview coaching service accessed via WhatsApp, including the generation and delivery of coaching documents.

2. Who Can Use the Service

The service is designed for university graduates and current university students. You must be at least 18 years of age to use the service. By using the service, you confirm that you are 18 or older.

4. Acceptable Use

You agree to submit only genuine CVs and career-related documents for review. We reserve the right to refuse service, withhold outputs and block accounts where submitted content contains material that is offensive, harmful, illegal or otherwise inappropriate. Where service is refused for these reasons, no refund will be issued. We may exercise this right at any time, including after outputs have been delivered, if we determine upon review that submitted content violated this clause.

5. What the Service Is Not

The coaching documents are generated by AI and are intended as guidance only. They do not constitute:

We do not review, endorse or guarantee the accuracy of the AI-generated content. While we invest significant effort in the quality of our AI pipeline, the outputs reflect automated analysis and may contain errors or recommendations that are not appropriate for your specific circumstances.

6. Payment

Payment is required before the service processes your CV. Payment is handled by Stripe. We do not store your credit card or bank account details.

All prices are displayed in Australian dollars (AUD) or British pounds (GBP) depending on your phone number’s country code. The currency is determined automatically and applied consistently across all your purchases.

Each CV submission is a separate paid transaction. If you submit an updated CV, you pay again for a new analysis.

7. Refunds

Because the service delivers digital coaching documents generated specifically from your CV, refunds are generally not available once the documents have been delivered.

We will consider a refund if:

To request a refund, message us on WhatsApp or email privacy@trypenguin.ai within 14 days of your payment. We will review each request on its merits.

Nothing in these terms excludes, restricts or modifies any consumer guarantee under the Australian Consumer Law that cannot be excluded, restricted or modified by agreement.

The coaching documents generated for you are yours to use for personal career development purposes. You may share them with mentors, career advisers or trusted contacts.

The TryPenguin service, brand, pipeline logic, AI prompts and all associated intellectual property remain the property of Mint Nimbus Pty Ltd ATF G&G Anderson Family Trust. Nothing in these terms grants you any rights to our intellectual property beyond the personal use of your coaching documents.

10. Privacy

We collect and process personal information in accordance with our Privacy Policy. By using the service, you acknowledge that you have read and understood the Privacy Policy.

11. Service Availability

We aim to keep the service available but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates or circumstances beyond our control (including third-party service outages from WhatsApp, Stripe or Anthropic).

We are not liable for any loss or inconvenience caused by temporary unavailability of the service.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from or related to the service is limited to the amount you paid for the specific service that gave rise to the claim.

We are not liable for any indirect, incidental, consequential or special damages, including loss of opportunity, loss of income or loss arising from reliance on the coaching documents.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability under the Australian Consumer Law.

13. Anti-Gaming and Enforcement

We reserve the right to block access to the service if we reasonably believe you are:

If your access is blocked due to a Stripe chargeback, the block remains in effect until the dispute is resolved.

14. Data Deletion

You can request deletion of your personal data at any time by sending “delete my data” on WhatsApp or emailing privacy@trypenguin.ai. See our Privacy Policy for full details on what is deleted and what is retained for legal compliance.

15. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you via WhatsApp before the changes take effect. Continued use of the service after notification constitutes acceptance of the revised terms.

16. Governing Law

These terms are governed by the laws of Victoria, Australia. Any dispute arising from these terms or the service will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
